The Right Honourable Tan Sri Dato’ Sri Azahar Bin Mohamed was born on 27th April 1956 in Johor Bahru, Johor. Justice Azahar bin Mohamed obtained his LLB degree from University of Malaya in 1980 and LLM from London School of Economics in 1987. Justice Azahar has had a long career with the Judicial and Legal services since 1980.

 

His Lordship has held several positions, amongst them are:

  • Senior Assistant Registrar, High Court, Johor Bahru (1980);
  • Deputy Public Prosecutor, Pahang (1983);
  • Deputy Public Prosecutor, Negeri Sembilan (1987);
  • Deputy Public Prosecutor, Kelantan (1990);
  • Senior Federal Counsel, Anti-Corruption Agency (1991);
  • Legal Adviser, Royal Customs and Excise Department Malaysia (1992);
  • Deputy Registrar of Companies (1992);
  • Deputy Head of Prosecution, Attorney General’s Chambers (1996);
  • Head of Prosecution, Attorney General's Chambers (1997); and
  • Head of Civil Division, Attorney General's Chambers (2000).

 

On 1st August 2004, Justice Azahar Mohamed was appointed as a Judicial Commissioner and served the High Court at Johor Bahru. On 27th July 2006, His Lordship was elevated as a High Court Judge of Malaya. On 1st January 2009, His Lordship served the High Court of Commercial Division, Kuala Lumpur. On 1st May 2009, His Lordship served as Intellectual Property Judge, Kuala Lumpur High Court.  On 11th May 2011, His Lordship was elevated as a Judge, Court of Appeal. On 12th 2014, His Lordship was elevated as a Federal Court Judge.

On 9th October — 31st December 2015, Awarded Visiting Fellowship of Inns of Court at the Institute Advanced Legal Studies, University of London.

 

Justice Azahar Mohamed was a Managing Judge of Kuala Lumpur High Court (Civil Division, Criminal Division, Family Court, Construction Court and Appellate & Special Powers Division) (2012 — 2017).

On 8th February 2018, His Lordship was appointed as a Judge of the Special Court pursuant to Article 182 of the Federal Constitution.

On 17th May 2019, His Lordship was designated by the Right Hon. Chief Justice to exercise the powers and perform the duties of the Chief Judge of Malaya and on 08th August 2019, His Lordship was appointed as the Chief Judge of Malaya.

The Right Honourable Tan Sri Dato’ Abang Iskandar bin Abang Hashim was born on 3 July 1959 in Sibu, Sarawak.

 

His Lordship’s career in the Judicial and Legal Service began on 1 August 1983 when he was appointed as a Magistrate in Miri, Sarawak before being transferred to the Magistrate’s Court of Limbang in the same year and to the Magistrate’s Court of Sibu in the following year.

 

From the court, His Lordship crossed to Sarawak Legal Aid Bureau in 1989. A year later, His Lordship returned to the court as a Session Court Judge, at the Kuala Lumpur Sessions Court.

 

His Lordship gained vast experience when he had the opportunity to join various government departments in his service. From 1992 until 1994, His Lordship was posted as the Legal Advisor of the Fisheries Department, Ministry of Agriculture.

 

From 1994 until 2000, His Lordship led the General Crime Unit, Prosecution Division, Attorney General’s Chambers, Kuala Lumpur and the Commercial Crime Unit, Prosecution Division, Attorney General’s Chambers, Putrajaya as the Head of Unit.

 

His Lordship was then appointed as the Chairman of the Department of Cooperative Development Malaysia Tribunal, Kuala Lumpur in 2000 and held the post for one year before being seconded to the Central Bank of Malaysia, Kuala Lumpur as the Head of Prosecution Unit/ Deputy Public Prosecutor. Two years later, His Lordship returned to the Attorney General’s Chambers, Putrajaya as the Head of the Commercial Crime Unit, Prosecution Division for a period of one year i.e. from the year 2003 until 2004.         

 

His Lordship’s journey in the legal profession continued when in the year of 2004, His Lordship was seconded to the Malaysia Securities Commission Malaysia, Bukit Kiara, Kuala Lumpur as the Director of Enforcement Division until the year 2007.

 

On 1 March 2007, His Lordship was appointed by the DYMM Seri Paduka Baginda Yang di-Pertuan Agong as a Judicial Commissioner. In the same year, His Lordship was also appointed as the Chairman of the Appeal Board, Board of Engineers Malaysia, by DYMM Seri Paduka Baginda Yang di-Pertuan Agong.

 

His Lordship served at the High Court of Shah Alam, Selangor from 1 March 2007 until 31 April 2009 as Judicial Commissioner before being transferred to Kuala Lumpur High Court on 1 May 2009.  

 

On 14 October 2009, His Lordship was appointed by DYMM Seri Paduka Baginda Yang di-Pertuan Agong as a High Court Judge. His Lordship continued to serve in the Kuala Lumpur High Court in various divisions until 31 December 2012.

 

On 2 January 2013, His Lordship was transferred to the Penang High Court. Nine months later, i.e. on 30 September 2013, His Lordship was elevated as a Judge of the Court of Appeal, Malaysia.

 

His Lordship was appointed by DYMM Seri Paduka Baginda Yang di Pertuan Agong as a Federal Court Judge on 26 November 2018 and on 20 February 2020, His Lordship was appointed as the Chief Judge of Sabah and Sarawak.

 

To appreciate His Lordship’s contribution in the Civil Service, His Lordship was awarded with Pingat Darjah Setia Pangkuan Negeri (DSPN) by Tuan Yang di Pertua of Pulau Pinang on 27 August 2013.His Lordship was then  conferred with federal award Panglima Setia Mahkota which carries title "Tan Sri" on 13 November 2021.

 

The Right Honourable Tan Sri Dato’ is married to YBhg. Puan Sri Datin Fadzillah binti Dato’ Kamaruddin and they are blessed with three (3) children.

The Right Honourable Tun Tengku Maimun binti Tuan Mat was born in Kota Bharu, Kelantan on 2 July 1959. Her Ladyship read law at University of Malaya and graduated with honours in 1982.

 

Her Ladyship began her career in the legal field as a Legal Officer at the Southern Kelantan Development Board (KESEDAR) in 1982 and later in 1984, as a Legal Officer at the Municipal Council of Seremban, Negeri Sembilan. Her Ladyship joined the Judicial and Legal Service in 1986 as an Assistant Parliamentary Draftsman, at the Drafting Division of the Attorney-General’s Chambers. Subsequently, Her Ladyship served as a Magistrate at the Port Dickson Court, as a Federal Counsel at the Kuala Terengganu Legal Aid Bureau, as a Senior Assistant Registrar at the High Court at Seremban, as a Deputy Registrar at the High Court of Kuala Lumpur, as a Special Officer to the Right Honourable Chief Judge of Malaya, as a Special Officer to the Right Honourable Chief Justice, as a Judge of the Sessions Court at Kuala Lumpur cum Special Officer to the Right Honourable Chief Justice, and as the Registrar of the High Court of Malaya cum Chief Registrar of the Federal Court of Malaysia. Her Ladyship’s final posting in the Judicial and Legal Service was as the Chief Registrar of the Federal Court of Malaysia from 2005 to 2006.

 

On 2 October 2006, Her Ladyship was appointed as a Judicial Commissioner of the High Court of Malaya at Kuala Lumpur. On 5 September 2007, Her Ladyship was elevated as a Judge of the High Court of Malaya at Kuala Lumpur. Her Ladyship also had the experience of serving as a Judge of the High Court of Malaya at Shah Alam, Selangor.

 

On 8 January 2013, Her Ladyship was appointed as a Judge of the Court of Appeal. On 26 November 2018, Her Ladyship was appointed as a Judge of the Federal Court. On 2 May 2019, Her Ladyship was appointed as the Chief Justice of Malaysia.

 

Her Ladyship was conferred with Darjah Seri Paduka Setia Mahkota Kelantan (SPSK) in 2016 carrying the title Dato’ and in 2006, with Darjah Dato’ Paduka Setia Mahkota Kelantan (DPSK) also carrying the title Dato’. On 13th July 2019, Her Ladyship was conferred with Darjah Utama Pangkuan Negeri carrying the tittle Dato' Seri Utama. On September 10th 2019, Her Ladyship was conferred with Darjah Panglima Mangku Negara carrying the tittle Tan Sri and on August 17th 2020, Her Ladyship was conferred with Darjah Seri Setia Mahkota carrying the tittle Tun.

Civil Claim

 

·  A civil claim is a legal and factual dispute between two or more parties claiming for remedies, damages or compensation.

 

 

  

  • A claim by an individual not more than RM5,000.00 can be filed in the Small Claims Court.
  • The Magistrates’ Court will hear all civil claims up to RM100,000.00.
  • The Sessions Court will hear all civil claims between RM100,001.00 to RM1,000,000.00
  • The High Court can hear all monetary claims (unlimited jurisdiction).

Before you file a claim in Court you should first consider the following:

  1. Cause of action. Is there a proper basis for your claim?
  2. Limitation period. Are you within time to file your claim?
  3. Evidence. How will you back up your claim? Do you have the necessary evidence in the form of documents or witnesses?
  4. Costs of litigation. You will need to incur Court filing fees and litigation may take up a substantial amount of your time. You should also consider the possibility of losing your case and the consequences of that - such as being ordered to pay your opponent’s costs.

If your claim involves a substantial dispute as to the facts, then it must be commenced by way of Writ.

  • The writ must be endorsed with a Statement of Claim or a concise statement of what your claim or the relief or remedy you seek.
  • There must be sufficient information and particulars in the statement for the Defendant to be clear about what it is you are claiming against him/her for.
  • State the number of days that the Defendant(s) has to enter an appearance to your Writ.

The writ can be served in the following manner:

  • Personal Service / by way of Prepaid AR Registered Post addressed to his last known address
  • If personal service failed, an application for substituted service shall be filed
  • The address of your residence 
  • If your address is not in Malaysia, or if you do not have a place of residence in Malaysia, then give an address within Malaysia that documents may be delivered to you at.
  •  Your occupation

  i) What is Originating Summons (“OS”)

OS is to be used when it is required by a statute, a dispute which is concerned with matters of law and where there is unlikely to be any substantial dispute of facts. Hence, OS should not be used if there are dispute of facts.

 

  ii) Features of OS

  •  The OS must be filed together with an Affidavit in Support exhibiting documentary evidence intended to be relied on
  •  It is heard by a Judge
  •  No pleadings are required.
  •  

 

 iii) Contents of an OS

A statement for determination or for direction or a concise statement of the relief or remedy claimed,

Particulars to identify cause or causes of action in respect of which the Plaintiff claims that relief or remedy

Filing can be done at the Court Registry depending on your location. You will then need to extract a sealed copy of the same and serve your Court papers to the Defendant within 6 months.
